General Terms of Service
Version applicable from: 4 August 2026
These terms govern services provided under the trading name AXPRO® by Adrian Leş, sole trader, Belgian enterprise number 0725.418.359, VAT BE 0725.418.359, established at Georges Hensmansstraat 73, 1600 Sint-Pieters-Leeuw. Contact: info@axpro.be – +32 484 04 32 65.
1. Definitions and scope
In these terms:
- AXPRO means Adrian Leş trading as AXPRO®.
- Client means any individual or legal entity requesting or ordering a service.
- Consumer means an individual acting for purposes outside their professional activity.
- Business Client means a client acting in the course of their professional activity.
- Intervention means the expressly agreed checks, measurements, tests, investigations, inspections, diagnostics, reports or works.
These terms apply to AXPRO quotations, orders, appointments, interventions, reports and invoices. Mandatory Belgian legal provisions always remain applicable. Specific terms in a quotation or written confirmation prevail in the event of conflict.
2. Requests, quotations and formation of the contract
A request by telephone, form, email, WhatsApp or social media does not necessarily constitute a final order. The contract is formed when the Client accepts a quotation, order form, written assignment confirmation or appointment whose price and scope have been communicated sufficiently clearly.
Unless otherwise stated, a quotation is valid for thirty calendar days. Oral or remote estimates rely on information supplied by the Client and may be adjusted if the actual situation differs substantially.
Any additional service or technique involving an extra charge requires the Client’s prior agreement, except urgent measures needed to prevent immediate danger or limit damage, within the limits permitted by law.
3. Information supplied by the Client
The Client must provide complete and accurate information about the problem, installations, previous works, available plans, risk areas, fragile materials, possible asbestos, concealed pipes or cables and any circumstance relevant to safety or diagnosis.
AXPRO is not responsible for consequences directly caused by false, incomplete or concealed information, without prejudice to mandatory liability rules.
4. Access, safety and preparation
At the agreed time, the Client must provide lawful, safe and sufficient access to the building, rooms, meters, valves, installations and areas to be checked. Where necessary, they obtain permission from the owner, occupant, property manager or other relevant person.
Where required, the Client provides water, electricity, drain access, keys, plans and reasonable necessary resources. Animals must be kept away and work areas cleared.
AXPRO may interrupt or postpone an intervention where danger, unsanitary conditions, a non-compliant installation, insufficient access or other circumstances prevent reasonably safe work.
5. Nature of services and duty of reasonable endeavours
AXPRO uses professional techniques to investigate the presence, origin or probable location of a leak, water ingress, pressure loss, tightness defect, moisture problem or pipe or network anomaly.
Given building complexity, concealed networks, intermittent phenomena and the limitations of each method, AXPRO is subject to a duty of reasonable endeavours rather than a guaranteed result. An intervention may identify a probable cause, several hypotheses, no detectable anomaly at the time, or a need for additional tests.
Measurements and observations describe the situation at the time of the intervention. They do not guarantee that an installation will not subsequently develop a new leak or other failure.
6. Testing methods and targeted interventions
Depending on the assignment, AXPRO may use thermography, moisture measurements, acoustic detection, tracer gas, pressure tests, fluorescein, smoke testing, camera inspection, microcamera, telescopic camera, radio detection or sonde locating.
“Non-destructive” methods aim to limit unnecessary openings but do not guarantee that dismantling, drilling, removal or opening will be entirely avoided. Any opening or intervention liable to alter a building component requires the Client’s agreement, except a safety emergency provided for by law.
Ground markings, depth estimates and network routes remain indicative. They do not replace official plans, network operators’ information or mandatory precautions before excavation, drilling, cutting or demolition.
7. Reports, photographs and conclusions
Where included or separately ordered, a report records relevant findings, tests performed, available results, relevant photographs and technical recommendations. The announced delivery time is indicative unless otherwise agreed in writing.
The report is prepared for the Client and the stated assignment. It is not a court-appointed expert assessment, structural study, conformity certificate, repair guarantee or insurance coverage decision.
Photographs and videos taken during the intervention document the case, illustrate the report, support follow-up and defend the parties’ rights. AXPRO avoids recording identifiable people or private elements without technical relevance where possible.
8. Prices, VAT and expenses
Applicable prices are those in the quotation, appointment confirmation, communicated tariff or invoice. VAT is applied at the statutory rate appropriate to the nature and conditions of the service.
Unless otherwise stated, parking, tolls, permits, special access equipment, equipment hire, external analyses and exceptional travel may be charged additionally where announced or reasonably required for the assignment.
Possible payment by an insurer, property manager, owner or third party does not release the Client from their payment obligation unless that third party has expressly committed to AXPRO in writing.
9. Deposit
AXPRO may request a deposit before reserving a time slot, ordering materials or starting an assignment. The order then becomes final when the deposit is received, subject to any applicable Consumer withdrawal right.
10. Timescales and appointments
Arrival times and completion periods are indicative, notably because of traffic, varying duration of previous interventions, access conditions and on-site findings. AXPRO informs the Client within a reasonable time of any known significant delay.
A reasonable delay does not automatically entitle the Client to a reduction, cancellation or compensation, without prejudice to mandatory Consumer rights and specific written commitments.
11. Cancellation or rescheduling
The Client is asked to cancel or reschedule at least twenty-four hours before the appointment. For late cancellation, absence, an inaccessible address or inability to intervene attributable to the Client, AXPRO may request reasonable compensation proportionate to actual costs and reserved time, not exceeding 30% of the agreed intervention price.
No compensation is due if the Client demonstrates force majeure. If AXPRO cancels late without force majeure, deposits for the unperformed service are refunded and the Client may claim reasonable, proven direct costs within the same limit.
This article does not limit the statutory withdrawal right below.
12. Consumer withdrawal right
For a distance or off-premises contract, unless a statutory exception applies, the Consumer has fourteen calendar days from the day following conclusion of the service contract to withdraw without giving a reason.
This right may be exercised by a clear statement sent to info@axpro.be or by post to AXPRO, Georges Hensmansstraat 73, 1600 Sint-Pieters-Leeuw. The model at the end of these terms may be used but is not mandatory.
If the Consumer expressly requests that work start before the fourteen-day period expires, they may withdraw until the service is fully performed but must pay an amount proportionate to services already supplied. After full performance, the withdrawal right ends if the Consumer expressly requested the early start and acknowledged losing the right once the service was fully performed.
For urgent repairs or maintenance expressly requested at the Consumer’s home, statutory exceptions may apply strictly within the requested urgency. Additional services not expressly requested remain subject to ordinary legal rules.
13. Invoicing and payment
Unless otherwise agreed in writing, payment is due at the end of the intervention or on the invoice due date, using methods accepted and communicated by AXPRO.
Any dispute must be reasoned and promptly sent in writing with invoice references and relevant information. The undisputed part remains payable. Consumer rights are not limited by a contractual dispute period shorter than the statutory period.
14. Late payment by a Consumer
AXPRO first sends a free reminder on a durable medium. No interest or compensation is requested before expiry of the statutory minimum of fourteen calendar days, calculated under the Belgian Code of Economic Law.
After that period, and only where these terms have been validly accepted, AXPRO may request:
- Late interest no higher than the maximum permitted under Belgian law.
- Fixed compensation within statutory caps: 20 euros for a balance up to 150 euros; 30 euros plus 10% of the portion between 150.01 and 500 euros for a balance from 150.01 to 500 euros; 65 euros plus 5% of the portion above 500 euros, capped at 2,000 euros, for a balance exceeding 500 euros.
No other costs are charged beyond those permitted by mandatory legislation.
15. Late payment by a Business Client
Unpaid amounts bear interest automatically and without formal notice where permitted by law, at the rate for commercial transactions under the Belgian law of 2 August 2002. A minimum fixed sum of 40 euros for recovery costs is also due, without prejudice to reasonable reimbursement of additional recovery costs permitted by law.
AXPRO may suspend other services after written notification while overdue amounts remain unpaid.
16. Complaints and reinspection
A Client who considers a conclusion or measurement incorrect must contact AXPRO as soon as possible and, where reasonably possible, allow reinspection before alterations, destructive repairs or disappearance of useful evidence.
Reinspection is not an admission of liability. It may be charged if the problem is different, the situation has changed or the original conclusion is confirmed.
17. Liability
AXPRO is liable for attributable damage in accordance with Belgian law. Liability concerns direct, foreseeable and sufficiently proven damage causally linked to AXPRO’s fault.
AXPRO is not responsible for pre-existing defects, normal wear, non-compliant installations, unobservable intermittent phenomena, inaccessible areas, inaccurate plans, third-party works or damage resulting from instructions contrary to its recommendations.
No provision excludes or limits liability that cannot legally be excluded or limited, particularly intentional fault, harm to physical integrity or mandatory Consumer protection.
For Business Clients only and where legally permitted, AXPRO is not liable for indirect losses such as lost turnover, business interruption, data loss, lost opportunities or commercial harm unless otherwise committed in writing.
18. Force majeure
Neither party is liable for delay or non-performance caused by an unforeseeable and unavoidable event reasonably outside its control, such as a major breakdown, accident, sudden illness, strike, natural disaster, dangerous weather, supply interruption or official decision.
The affected party informs the other within a reasonable time. If the impediment becomes lasting, either party may end the unperformed part without compensation, subject to payment for services already performed.
19. Subcontracting and specialised third parties
AXPRO may use a collaborator or specialised provider where needed, while remaining responsible for proper coordination within legal limits. Third-party analyses or advice may have a separate price announced to the Client.
20. Personal data
Personal data is processed under AXPRO’s Privacy Policy. Photographs, videos and technical information needed for the intervention may be retained for contract performance, follow-up, invoicing, legal obligations and defence of the parties’ rights.
21. Mediation, applicable law and courts
The parties favour an amicable resolution. The Consumer must first send their complaint to AXPRO at info@axpro.be.
If unresolved, the Consumer may contact the Consumer Mediation Service free of charge: Boulevard du Roi Albert II 8, box 1, 1000 Brussels, contact@mediationconsommateur.be, mediationconsommateur.be.
Belgian law governs the contract. Mandatory rules determine the competent courts for Consumers. For Business Clients, the competent courts of the Brussels judicial district have jurisdiction unless a mandatory rule or different written agreement applies.
22. Partial invalidity and amendments
If a provision is invalid or unenforceable, the others remain valid. Where permitted, it is replaced by a valid rule as close as possible to its purpose.
AXPRO may amend these terms for the future. The version communicated or accessible when the contract was formed applies. Later changes do not apply retrospectively to an order already concluded.
